Singer / Songwriter Marc Toms has been working as a solo artist under the name Defacto since 1995, releasing a number of EPs, including 2003's Moonshine and Rain.

In the early summer of 2005 Marc recruited drummer David Tye and bassist Alan Warren. Several guitarists, and one EP later, Defacto were joined by Dockside studio's Ellen Morgan on lead guitar. In the summer of 2006 Defacto became a five piece, with the addition of Ross Hawkins on keys.
